GeoKerja Terms of Use

These Terms of Use ("Terms") govern your access to and use of the GeoKerja mobile application, web application and all related services (collectively, the "Service"). GeoKerja is a workforce attendance and workforce management platform operated by Nonplus Sdn. Bhd.

By accessing or using GeoKerja, you acknowledge that you have read, understood and agree to be legally bound by these Terms. If you do not agree to these Terms, you must discontinue use of the Service immediately.

GeoKerja is made available through organisations that subscribe to the Service. Your employer or organisation is responsible for issuing your account, determining how GeoKerja is used within the workplace and establishing policies relating to attendance, payroll, human resources and workforce management.

GeoKerja provides the technology platform and records attendance transactions but does not independently determine employment rights, disciplinary action, payroll entitlements or any employment decision.

You may use GeoKerja only if you are an authorised employee, contractor or other authorised representative of an organisation that has licensed the Service. You must use only the account assigned to you and must maintain the confidentiality of your login credentials.

You are responsible for all activities carried out using your account unless you promptly notify your employer or GeoKerja of any unauthorised access. Where available, you are encouraged to enable biometric authentication or other security features provided by your device.

GeoKerja records attendance by verifying information submitted at the time of check-in or check-out. Depending on your employer's configuration, this may include location verification against an approved workplace, project site or authorised work-from-home location. The Service may also allow submission of attendance correction requests, supporting documents, notifications and other workforce management features.

Attendance records generated by GeoKerja are intended to support your employer's internal business processes and should not be interpreted as an independent confirmation of working hours or employment entitlements.

You agree to use GeoKerja only for legitimate workplace purposes and in accordance with all applicable laws, your employer's policies and these Terms.

You must not attempt to falsify attendance records, manipulate device location, use GPS spoofing or mock-location software, submit attendance on behalf of another person, share your account credentials, upload unlawful or malicious material, interfere with the operation or security of the Service, reverse engineer the software except where expressly permitted by law, attempt unauthorised access to any system or network or use the Service for any fraudulent, illegal or abusive purpose.

GeoKerja and your employer reserve the right to investigate suspected misuse and to suspend or terminate access where appropriate.

You are responsible for ensuring that attendance actions are performed accurately and at the appropriate time. If you believe an attendance record is incorrect or incomplete, you should submit a correction request through the Service together with any supporting information required by your employer.

Approval, rejection or amendment of attendance records remains solely within your employer's discretion and GeoKerja is not responsible for employment decisions made using attendance information.

Where you submit comments, documents, photographs or other content through GeoKerja, you retain any ownership rights you already possess in that content. By submitting such content, you grant GeoKerja and your employer a non-exclusive, worldwide, royalty-free licence to store, process, reproduce, transmit and otherwise use the content solely for operating, maintaining, securing and administering the Service and related employment processes.

You represent that you have the necessary rights and authority to upload any content you submit and that such content does not infringe the rights of any third party or violate any applicable law.

GeoKerja requires a functioning internet connection for attendance verification, synchronisation of records, submission of requests and receipt of notifications. Offline attendance recording is not supported unless expressly implemented by your employer. You are responsible for confirming that attendance transactions have been successfully submitted before relying on them.

While GeoKerja aims to provide a reliable and secure service, uninterrupted availability cannot be guaranteed. The Service may be temporarily unavailable because of scheduled maintenance, technical issues, internet connectivity, third-party services, force majeure events or circumstances beyond our reasonable control.

GeoKerja may modify, enhance, suspend or discontinue features at any time in order to improve security, functionality, legal compliance or operational performance.

All intellectual property rights relating to GeoKerja, including the software, source code, databases, interfaces, documentation, trademarks, logos, designs, graphics and other content, remain the exclusive property of Nonplus Sdn. Bhd. or its licensors.

These Terms grant you only a limited, non-exclusive, non-transferable and revocable licence to use GeoKerja solely for your authorised employment-related purposes. No ownership rights are transferred to you.

To the maximum extent permitted by applicable law, GeoKerja is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied or statutory. GeoKerja does not warrant that the Service will always operate without interruption, that attendance verification will always be successful in every environment, that GPS readings will always be accurate, or that the Service will always be free from errors, viruses or other harmful components.

To the fullest extent permitted by law, Nonplus Sdn. Bhd., its affiliates, directors, employees, officers and service providers shall not be liable for any indirect, incidental, consequential, exemplary, punitive or special damages, including loss of profits, business interruption, loss of employment opportunities, payroll disputes, data loss or reputational damage arising from the use of or inability to use GeoKerja.

GeoKerja shall not be responsible for employment, disciplinary, payroll or management decisions made by your employer using attendance records generated through the Service. Nothing in these Terms excludes or limits liability that cannot legally be excluded under applicable law.

Your employer may suspend, restrict or terminate your access to GeoKerja at any time in accordance with its internal policies. GeoKerja may also suspend or terminate access where reasonably necessary to protect the security, integrity or lawful operation of the Service, investigate suspected misuse, comply with legal obligations or enforce these Terms.

GeoKerja may amend these Terms from time to time to reflect changes in applicable law, technology, security requirements, business operations or platform functionality. The latest version will be made available through the application together with the effective date. Continued use of GeoKerja after revised Terms become effective constitutes your acceptance of those revised Terms to the extent permitted by applicable law.

These Terms shall be governed by and construed in accordance with the laws of Malaysia unless otherwise provided in the applicable agreement between GeoKerja and your employer. The courts of Malaysia shall have exclusive jurisdiction over any dispute relating to these Terms unless otherwise required by mandatory law or agreed in writing.
